TRA signals negative determination in US HVO biodiesel subsidy case

The Trade Remedies Authority (TRA) has announced its intention to issue a final negative determination in its anti‑subsidy investigation into US hydrotreated vegetable oil (HVO) biodiesel.
After reviewing comments submitted in response to its Statement of Essential Facts (SEF) and considering newly available public information, the TRA has concluded that the US Blenders Tax Credit (BTC) no longer provides subsidisation to exporters.
The TRA’s interim findings, published in November 2025, had indicated that UK producers of fatty‑acid mono‑alkyl esters (FAME) biodiesel were experiencing injury as a result of subsidised HVO imports from the United States.
However, following industry feedback, the TRA determined that the BTC effectively ceased before 15 October 2025 and therefore no longer confers a benefit to US exporters. As a result, the TRA cannot recommend countervailing duties and intends to submit a final negative determination to the Secretary of State for Business and Trade.
This investigation covers the period from January to December 2024, examining HVO biodiesel—also known as renewable or green diesel—which can serve as a substitute for mineral diesel.
